The Patan High Court has issued an interim order to not immediately implement the decision of leasing over a ropani of government land in Durbar Marg to Thamserku Trekking of Yeti Group by the Nepal Trust.
Construction of the building at the place by Yeti Group has also been stopped by the court order. The trust had leased the land to Thamserku for 30 years.
The trust had first offered the land to the company at Rs 6.4537 billion in March 2017 and the company had initially accepted the offer. The company later demanded the rent be reduced and the trust three months later wrote to the company offering it at Rs 1.59 billion.
Advocate Paribartan Rai had moved the court stating that the trust had leased the government land in a way that the government suffered loss.
Chief Justice of the Patan High Court Nahakul Subedi hearing the petition has ordered to not immediately implement the decision stating that the correspondence by trust seems prima facie a violation of the Public Procurement Act, according to registrar at the court Baburam Dahal.
The court has summoned both the sides for hearing on Wednesday, and will decide whether to give continuity to the order or not after hearing arguments of both the sides.
The court has also asked for an amicus curiae including two senior advocates or advocates with the High Court Bar Association.
